JCH Group, LLC, doing business as Proxima Residencies (“Proxima,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you:

  • Communicate with us

  • Make a deposit or payment

  • Attend a Proxima residency

  • Otherwise interact with our services

Our website, applications, communications, bookings, payments, and residency experiences are collectively referred to as the “Services.”

1. Personal Information We Collect

The information we collect depends on how you interact with Proxima.

Information You Provide

We may collect:

  • Name, email address, telephone number, mailing address, billing address, age, and country of residence

  • Information submitted in a residency application, including musical background, interests, goals, experience, and reasons for applying

  • Information provided during application conversations, interviews, emails, or other communications

  • Reservation and participation details

  • Travel and arrival information

  • Dietary, allergy, health, accessibility, or accommodation information needed to support safe participation

  • Emergency-contact information

  • Parent or legal-guardian information when an applicant is under 18

  • Marketing and communication preferences

  • Feedback, testimonials, photographs, audio, video, or other content you choose to provide

  • Payment and transaction information, including deposits, balances, refunds, and billing records

Payments may be processed through Shopify and its payment partners. Proxima generally does not directly receive or store complete payment-card numbers.

Please do not include sensitive personal information in an application unless we specifically request it and it is reasonably necessary. When required by law, we will obtain consent before collecting or using sensitive personal information.

If you provide information about another person, such as a guest, emergency contact, parent, or guardian, you confirm that you have permission to provide that information.

3. Residency Applications and Selection

Submitting an application does not guarantee admission to a Proxima residency.

Applications are reviewed personally. We may use the information submitted in an application and information learned through subsequent conversations to evaluate whether the experience is likely to be a suitable fit for the applicant and the residency group.

We do not use solely automated decision-making to determine whether an applicant is accepted.

Application information will not be used for unrelated purposes without permission, except where otherwise permitted or required by law.

4. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

Technology and Service Providers

These may include companies that provide:

  • Website hosting and ecommerce services

  • Application and form-management services

  • Payment processing

  • Email and communications

  • Analytics and advertising

  • Customer support

  • Accounting, administration, and recordkeeping

These companies may process information as needed to provide their services to us or as described in their own privacy policies.

Residency Partners

For accepted participants, we may provide necessary information to:

  • Residency venues

  • Participating artists and program personnel

We limit this information to what is reasonably necessary for booking, administration, communication, safety, accommodation, and delivery of the experience.

  • Manage reservations and residency participation

  • Maintain accounting, tax, transaction, and business records

  • Enforce agreements

The retention period depends on the nature and sensitivity of the information, why it was collected, and applicable legal requirements.

When information is no longer reasonably necessary, we may delete, anonymize, or securely dispose of it.

However, no method of internet transmission or electronic storage is completely secure. We cannot guarantee absolute security.

If we deny your request, you may appeal by replying to our decision with the subject line Privacy Appeal and explaining why you believe the decision should be reconsidered.

We will respond within the time required by applicable law. These rights may be subject to legal limitations and exceptions.

11. International Visitors

Proxima is based in the United States. Information may be transferred to, stored in, or processed in the United States, Canada, or other countries where our service providers operate.

Those countries may have privacy laws different from the laws where you live. Where required, we use legally recognized protections for international data transfers.

For individuals in the European Economic Area, United Kingdom, or Switzerland, we generally process personal information on one or more of these legal bases:

12. Age Requirements and Children’s Privacy

Age requirements may vary by residency. The applicable age requirement will be displayed on the individual residency page and application.

When a residency permits applicants under 18:

  • A parent or legal guardian must participate in or authorize the application

  • The parent or guardian may be required to provide contact and verification information

  • The parent or guardian must approve payment and participation

  • Additional consent forms, releases, or supervision requirements may apply

Our general website is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 without legally valid parental consent.

If we learn that we collected information directly from a child under 13 without the required consent, we will take reasonable steps to delete it.

A residency designed to include children under 13 will be subject to a separate parental notice and consent process.

13. Photography and Recordings

Residencies may be photographed, filmed, or recorded. When appropriate, we will provide advance notice and obtain any permissions or releases required for identifiable promotional use.

Declining optional promotional use will not affect an applicant’s consideration unless photography or recording is an essential and clearly disclosed element of that particular residency.

14. Third-Party Websites

Our website may link to services operated by other organizations. We are not responsible for the privacy or security practices of third-party websites.

We encourage visitors to review the privacy policies of the websites they visit.

15. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our services, technology, business practices, or legal obligations.

When we make changes, we will update the effective date at the top. Where required, we will provide additional notice of material changes.
