This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit proximaresidencies.com (the “Site”), submit a residency application, communicate with us, complete an accepted booking, or participate in a Proxima residency.

1. Personal Information We Collect

The information we collect depends on how you interact with Proxima.

Information You Provide

We may collect the following information directly from you:

  • Contact information, including your name, email address, telephone number, mailing address, and preferred method of communication.
  • Application information, including your application responses, interests, artistic or professional background, residency preferences, eligibility information, and other information you choose to provide.
  • Booking and transaction information, including the residency selected, payment status, billing address, and transaction history.
  • Residency information, including lodging preferences, travel information, dietary requirements, accessibility needs, emergency-contact details, and other information reasonably necessary to arrange your participation.
  • Age or identity-verification information, when required to confirm eligibility for a particular residency, service, or activity.
  • Communications, including emails, inquiries, feedback, survey responses, and other correspondence with us.
  • Photographs, video, audio, or other media, when you submit that material to us or when media is captured during a residency in accordance with an applicable notice, consent form, or release.
  • Marketing preferences, including whether you have agreed to receive newsletters, residency announcements, or other promotional communications.

Please do not provide sensitive information that we have not requested. When we request information concerning accessibility, dietary requirements, health, identity, age, or safety, we use it only as reasonably necessary to evaluate an application, administer a residency, accommodate a participant, comply with the law, or protect participants.

Payment Information

Payments for accepted applicants may be processed through Shopify and its payment partners. Proxima generally does not receive or store your complete payment-card number. Payment providers process that information according to their own privacy policies and security practices.

Information Collected Automatically

When you use the Site, we and our service providers may automatically collect:

  • IP address;
  • browser, device, and operating-system information;
  • pages viewed and links selected;
  • referring and exit pages;
  • dates, times, and duration of visits;
  • general or approximate location derived from an IP address;
  • application, booking, and checkout interactions;
  • cookie identifiers; and
  • other technical information concerning your use of the Site.

This information may be collected through cookies, pixels, tags, server logs, and similar technologies.

Information From Third Parties

We may receive information from third parties that help us operate Proxima, including:

  • Shopify and payment processors;
  • application and form-management providers;
  • email and communications providers;
  • analytics and advertising partners;
  • social-media platforms;
  • lodging, transportation, venue, event, and residency partners;
  • identity-verification and fraud-prevention providers; and
  • other service providers assisting with our operations.

2. How We Use Personal Information

We may use personal information to:

  • operate, maintain, secure, and improve the Site;
  • receive, review, and evaluate residency applications;
  • determine whether an applicant meets the requirements of a residency;
  • communicate with applicants regarding their application status;
  • invite accepted applicants to complete a private booking and payment;
  • process payments and maintain transaction records;
  • arrange lodging, meals, transportation, accessibility accommodations, and other residency services;
  • communicate important information before, during, and after a residency;
  • respond to inquiries and provide support;
  • administer youth residencies through a participant’s parent or legal guardian;
  • send newsletters, announcements, and promotional communications when permitted by law;
  • understand how visitors use the Site;
  • measure the effectiveness of our communications and advertising;
  • personalize Site content where permitted;
  • detect fraud, misuse, security incidents, and other harmful activity;
  • enforce our terms, policies, and agreements;
  • comply with legal, tax, accounting, safety, and regulatory obligations; and
  • protect the rights, safety, and property of Proxima, our applicants, participants, artists, partners, and others.

Submitting an application does not guarantee acceptance into a residency.

3. Youth Residencies and Children’s Privacy

The general Proxima Site is not directed to children under the age of 13.

If a residency is specifically designed for participants under 18, the application must be submitted by the prospective participant’s parent or legal guardian. Youth-residency pages and application forms are intended for parents and guardians, not for direct submission by minors.

For youth residencies, we may ask the parent or guardian to provide information about the prospective participant, including:

  • the participant’s name and age;
  • interests and application responses;
  • eligibility information;
  • dietary, accessibility, or safety requirements;
  • emergency-contact information; and
  • information reasonably necessary to evaluate the application or administer the residency.

We do not knowingly collect personal information directly from a child under 13 without legally sufficient parental notice and consent. If we learn that a child has submitted personal information directly to us without appropriate parental involvement, we may delete the information and take other appropriate action.

Parents and legal guardians may contact us to request access to, correction of, or deletion of personal information concerning their child, subject to applicable law and legitimate recordkeeping requirements.

Any photography, video, audio recording, publicity, or media use involving a minor will be governed by a separate parental or guardian consent or release when appropriate.

4. Cookies, Analytics, and Advertising

We and our partners, including Shopify, may use cookies and similar technologies to:

  • operate and secure the Site;
  • remember preferences;
  • provide checkout and booking functions;
  • understand how visitors use the Site;
  • perform analytics;
  • prevent fraud;

Residency Partners

We may provide necessary information to lodging providers, transportation providers, venues, artists, instructors, caterers, medical or safety personnel, event partners, and other parties involved in delivering a residency.

We limit these disclosures to information reasonably necessary for the recipient’s role.

Analytics and Advertising Partners

We may disclose device, cookie, and Site-usage information to analytics or advertising partners. Some privacy laws may define these disclosures as sharing, targeted advertising, or a sale.

Professional Advisers

We may disclose information to attorneys, accountants, insurers, consultants, and other professional advisers when reasonably necessary.

Legal and Safety Disclosures

We may disclose information when we reasonably believe it is necessary to:

The applicable retention period may depend on:

  • whether an application is pending, accepted, declined, or withdrawn;
  • whether an applicant participates in a residency;
  • the length of our relationship with the individual;
  • legal, tax, accounting, insurance, and contractual requirements;
  • safety, fraud-prevention, and dispute-resolution needs; and
  • whether the individual has agreed to receive future communications.

Application information may be retained for a reasonable period so we can administer the selection process, respond to inquiries, maintain appropriate business records, and, when authorized, contact an applicant regarding future residencies.

When information is no longer reasonably necessary, we may delete, de-identify, or securely archive it as permitted by law.

7. Your Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have the right to:

  • confirm whether we process your personal information;
  • request access to personal information we maintain about you;
  • request correction of inaccurate information;
  • request deletion of personal information;
  • receive certain information in a portable format;
  • opt out of the sale or sharing of personal information;
  • opt out of targeted advertising;
  • opt out of certain profiling activities;
  • withdraw consent where processing is based on consent;
  • limit certain uses of sensitive personal information; and
  • appeal a decision we make concerning a privacy request.

You will not be unlawfully discriminated against for exercising an applicable privacy right.

We may need to verify your identity before completing a request. Information provided for verification will be used only to process and document the request.

An authorized agent may submit a request where permitted by law. We may require evidence of the agent’s authority and direct verification from the individual concerned.

If we decline your request and applicable law gives you a right to appeal, email privacy@proximaresidencies.com with the subject line “Privacy Request Appeal” and explain why you believe the decision should be reconsidered.

8. Marketing Communications

You may unsubscribe from promotional emails by selecting the unsubscribe link included in an email or by contacting us at privacy@proximaresidencies.com.

Even if you unsubscribe from promotional communications, we may continue sending non-promotional messages concerning an application, booking, payment, residency, safety matter, privacy request, or our ongoing business relationship with you.

9. Information Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information.

However, no online service, transmission method, or storage system can be guaranteed to be completely secure. Please use caution when transmitting sensitive information by email. If we require particularly sensitive documentation, we may provide a more secure submission method.

10. International Visitors

Proxima is based in the United States. If you access the Site or submit information from another country, your information may be transferred to and processed in the United States or other countries where we or our service providers operate.

Those countries may have data-protection laws different from the laws in your jurisdiction. Where required, we use appropriate safeguards and process personal information according to an applicable legal basis, such as:

  • performing a contract;
  • taking steps requested before entering a contract;
  • complying with a legal obligation;
  • pursuing legitimate business interests;
  • protecting an individual’s vital interests; or
  • obtaining consent.
